IMPORTANT NOTICE

This Legal Disclaimer (“Disclaimer”) governs all business listings (“Listings”) published on the Ford Legends website and associated platforms (collectively, the “Platform”). By submitting a Listing for publication on the Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Disclaimer.

1. Definitions

In this Disclaimer, unless the context otherwise requires:

1.1 “Ford Legends” means Ford Legends (fordlegends.com), its owners, directors, employees, volunteers, contractors, and authorised representatives.

1.2 “Advertiser” means any individual, company, partnership, or other entity that submits a Listing for publication on the Platform.

1.3 “Listing” means any advertisement, announcement, or promotional content submitted by an Advertiser for publication on the Platform.

1.4 “Platform” means the Ford Legends website, mobile applications, social media accounts, print publications, and any other channels owned or operated by Ford Legends.

1.5 “Administrative Charges” means any costs incurred by Ford Legends in processing a Listing or a refund request.

2. Approval and Publication

2.1 All Listings submitted to Ford Legends must be approved before publication. Ford Legends reserves the absolute right to refuse publication of any Listing at its sole discretion without providing reasons.

2.2 The publication date of an approved Listing (“Live Date”) shall be the date on which the Listing first appears on the Platform.

2.3 Ford Legends makes no guarantees regarding the timing of the approval process or publication of Listings.

3. Cooling-Off Period and Cancellation

3.1 Following the Live Date, Advertisers shall have a grace period of fourteen (14) calendar days (“Cooling-off Period”) during which they may cancel their Listing and request a refund.

3.2 All cancellation requests must be submitted in writing to the contact details provided on the Platform.

3.3 After the expiry of the Cooling-off Period, the contract between Ford Legends and the Advertiser shall be deemed final, and no refunds shall be issued for any reason whatsoever.

4. Refunds

4.1 If a cancellation request is received within the Cooling-off Period, Ford Legends shall process a refund of the fees paid by the Advertiser, subject to the deductions set forth in clause 4.2.

4.2 All refunds shall be subject to deduction of: (a) Administrative charges, which may include but are not limited to staff time, processing costs, and other reasonable expenses incurred by Ford Legends; and (b) Bank transaction charges and any other payment processing fees applicable to the original payment and the refund.

4.3 The amount of Administrative charges shall be determined by Ford Legends at its reasonable discretion and shall reflect the actual costs incurred.

4.4 Refunds shall be processed using the same payment method as the original payment unless otherwise agreed in writing.

5. Platform Availability

5.1 Ford Legends does not guarantee uninterrupted access to the Platform and reserves the right to suspend access for maintenance, updates, or any other reason without prior notice.

5.2 In the event that the Platform becomes inaccessible or unavailable for any reason (“Downtime”), Ford Legends shall, at its sole discretion, extend the duration of all active Listings by a period equivalent to the Downtime.

5.3 The extension described in clause 5.2 shall be the Advertiser’s sole and exclusive remedy for any Downtime, and Ford Legends shall have no further liability in this regard.

5.4 Ford Legends shall be the sole arbiter of the duration of any Downtime and the corresponding extension to be applied to Listings.

6. Limitation of Liability

6.1 Ford Legends works diligently to ensure that the Platform is well-managed, secure, and current. However, Ford Legends makes no warranties, representations, or guarantees (whether express or implied) regarding the effectiveness of any Listing, the number of views or interactions a Listing may receive, or the commercial benefits that may arise from a Listing.

6.2 To the fullest extent permitted by law, Ford Legends expressly disclaims and shall have no liability whatsoever (whether in contract, tort, negligence, misrepresentation, strict liability, or otherwise) for:

• Any loss of profit, revenue, contracts, anticipated savings, business opportunity, goodwill, reputation, or any indirect or consequential loss arising from an Advertiser’s use of the Platform or the publication of a Listing
• Any errors, inaccuracies, omissions, or misleading statements in a Listing, whether caused by the Advertiser or any third party
• Any acts or omissions of third parties who access the Platform or respond to a Listing
• Any technical issues, including but not limited to server failures, system errors, data processing delays, or any other technical problems that may affect the publication or visibility of a Listing
• Any loss or damage arising from an Advertiser’s failure to comply with this Disclaimer or any applicable laws or regulations
• Any decision made or action taken by an Advertiser or any third party in reliance on a Listing or any information on the Platform

6.3 Without prejudice to the generality of clause 6.2, Ford Legends specifically disclaims any liability for any loss of earnings, revenue, or business opportunities through advertising or any other means in connection with the Platform.

6.4 The limitations and exclusions of liability set forth in this Disclaimer shall apply even if Ford Legends has been advised of the possibility of such damages.

6.5 Nothing in this Disclaimer shall limit or exclude Ford Legends’ liability for: (a) Death or personal injury caused by its negligence; (b) Fraud or fraudulent misrepresentation; or (c) Any other liability that cannot be excluded or limited by English law.

7. Advertiser Representations and Warranties

7.1 By submitting a Listing, the Advertiser represents and warrants that:

• They have the legal capacity and authority to enter into a binding agreement with Ford Legends
• All information provided in connection with the Listing is true, accurate, current, and complete
• The Listing does not infringe any intellectual property rights, privacy rights, or other rights of any third party
• The Listing complies with all applicable laws, regulations, and codes of practice, including but not limited to consumer protection laws, data protection laws, and advertising standards
• They have obtained all necessary licences, permissions, and consents required for the publication of the Listing

7.2 The Advertiser shall indemnify, defend, and hold harmless Ford Legends from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with any breach of the representations and warranties set forth in clause 7.1.

8. Content Moderation and Removal

8.1 Ford Legends reserves the right to edit, modify, or remove any Listing at any time and for any reason without notice.

8.2 Reasons for modification or removal may include, but are not limited to:

• Violation of this Disclaimer or any other policies of Ford Legends
• Complaints received from third parties
• Legal requirements or governmental requests
• Technical issues
• Any other reason that Ford Legends deems appropriate in its sole discretion

8.3 No refunds shall be issued for Listings that are modified or removed pursuant to clause 8.1.

9. Intellectual Property

9.1 By submitting a Listing, the Advertiser grants to Ford Legends a non-exclusive, royalty-free, worldwide licence to reproduce, publish, display, distribute, and otherwise use the Listing on the Platform and in promotional materials related to the Platform.

9.2 The Advertiser acknowledges that all intellectual property rights in the Platform (excluding the content of Listings) are owned by or licensed to Ford Legends.

10. General Provisions

10.1 This Disclaimer constitutes the entire agreement between Ford Legends and the Advertiser with respect to its subject matter and supersedes all prior agreements, understandings, and communications, whether written or oral.

10.2 If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

10.3 No failure or delay by Ford Legends in exercising any right under this Disclaimer shall operate as a waiver of that right, nor shall any single or partial exercise of any right preclude any further exercise of that or any other right.

10.4 Ford Legends reserves the right to modify this Disclaimer at any time by posting an updated version on the Platform. Continued use of the Platform after such modifications shall constitute acceptance of the modified Disclaimer.

10.5 This Disclaimer shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts for the resolution of any disputes arising under or in connection with this Disclaimer.
